Terms of Service

This is a courtesy translation for convenience. The Japanese version is the official text; in case of any discrepancy, the Japanese version prevails.

These Terms of Service (the "Terms") set out the conditions for using "DokiArcade" (the "Service") provided by the DokiArcade Operations Office ("we" or "us"). By using the Service, you are deemed to have agreed to these Terms.

Article 1 (Application)

These Terms apply to all relationships between users and us regarding use of the Service.

Article 2 (Definitions)

"Content" means images and other information generated, posted or published on the Service. "Points", "Words" and similar items are virtual features usable only within the Service; they have no monetary value and cannot be exchanged for or refunded in cash or otherwise.

Article 3 (Eligibility / Age Verification)

The Service is available only to persons aged 18 or older. Persons under 18 may not use the Service. You represent and warrant that you are at least 18 years old. False statements regarding age are prohibited. The Service handles adult (R-18) content including explicit sexual expression.

Article 4 (Accounts)

You may use the Service as a guest or by registering an email address. You are responsible for managing your account, and we are not liable for unauthorized use by third parties.

Article 5 (Points, Words, Generation)

Determinations regarding granting/spending Points, acquiring Words, and eligibility/limits for image generation are final as determined by our servers. Specifications, prices and limits may change without notice. Points etc. cannot be exchanged for cash, refunded or transferred, and are extinguished upon account suspension/deletion or termination of the Service.

Article 6 (Publication of Generated Images)

In principle, all images generated on the Service are published to the shared gallery and cannot be made private by users. We may hide or delete content we judge to violate law, these Terms or our operating policies without prior notice.

Article 7 (Content and Rights)

You grant us a non-exclusive license to use (reproduce, display, distribute, etc.) content you generate or publish, to the extent necessary to provide, promote and improve the Service. You are responsible for ensuring your use is lawful.

Article 8 (Prohibited Conduct)

You must not engage in any of the following:

• Acts that violate laws or public order and morals
• Generating, posting, requesting or distributing child pornography, child sexual abuse material, or expressions that evoke minors (we do not tolerate this under any circumstances)
• Obtaining, storing or distributing images in a manner that violates obscenity laws or other laws (including removing censorship)
• Infringing third parties' copyrights, portrait rights, privacy, honor or other rights
• Impersonating others or registering false information
• Unauthorized access, reverse engineering, or automated mass access/generation by bots etc.
• Interfering with the operation of the Service or placing excessive load on it
• Any other conduct we deem inappropriate

Article 9 (Content Policy and Measures)

The Service publishes content with mosaic censorship applied to genitals, anus, etc. Expressions that evoke minors are not handled. Inappropriate content may be deleted, and serious violations may result in account suspension or deletion.

Article 10 (Advertising)

Advertisements delivered by third parties may be displayed on the Service. We are not responsible for the content of advertisements or transactions with advertisers.

Article 11 (Intellectual Property)

Intellectual property rights in the Service and related programs, designs, trademarks, etc. belong to us or their rightful holders.

Article 12 (Disclaimer)

The Service is provided "as is". We do not warrant its completeness, accuracy, usefulness or fitness for a particular purpose. Except in cases of our willful misconduct or gross negligence, we are not liable for damages incurred by users in connection with the Service.

Article 13 (Changes, Suspension, Termination)

We may change the Service or suspend/terminate its provision without prior notice.

Article 14 (Restrictions / Account Suspension)

If you violate these Terms or where we otherwise deem necessary, we may delete content, restrict features, or suspend/delete your account without prior notice.

Article 15 (Governing Law / Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute between you and us regarding the Service shall be subject to the exclusive jurisdiction, in the first instance, of the district court or summary court having jurisdiction over the operator's location.

Article 16 (Amendments)

We may amend these Terms by notifying users (including posting on the Service). Continued use after amendment constitutes agreement to the amended Terms.

Article 17 (Official Text)

The Japanese version of these Terms is the official text. In case of any discrepancy between a courtesy translation (English, Chinese, Spanish, etc.) and the Japanese version, the Japanese version prevails.
